Insolvency Myths Solved HMRC is not preferential.

A common misconception is that tax and VAT are preferential creditors i.e. they are paid after a secured creditor e.g. a bank or lender but before the trade creditors and expense creditors (e.g. accountants). The Enterprise Act 2002 abolished HMRC's preferential status. In the Act only certain elements of employee claims retain a preferential status. If you have any queries on the Insolvency Act or the accompanying Rules, by all means feel free to pick our brains.David Bottomley FCAPartner

Fact Finder What is an IVA

Personal Service for Personal InsolvencyWe have always offered a face to face service for individuals and partners who have financial difficulties. We go that extra mile to negotiate a solution. There are a variety of formal and informal solutions. If you want to see the full list of seven options, email or telephone Paul who will send you an impartial guide describing them all. Our speciality is Individual Voluntary Arrangements (IVAs), a recovery plan which is often appropriate for sole-traders and for people whose circumstances differ from the norm. This is where we excel over our competitors. We ask a lot of questions. The more we know about the client's situation and prospects (warts and all) the better the IVA is structured to succeed. It remains that all too often clients have expended a large proportion of their resources paying off those creditors who shout the loudest. An IVA treats all creditors equally. In hindsight, many clients we help could have achieved a higher pence in the £ to perhaps fewer creditors if they had acted earlier and taken advice. Young Enterprise Mentoring for the Future. Your Country Needs You

After Paul's experience as a business advisor to the charity Young Enterprise in Rugby during the 2010/11 school year, he would thoroughly recommend it to anyone in business to take part. Now is the time to consider doing your bit for the business people of tomorrow by signing up to be a Young Enterprise advisor for the 2011/12 school year. If you are interested in taking part visit http://www.young-enterprise.org.uk/.It has proven to be valuable for the students to learn and experience how business works by running a limited company.Paul said he found it rewarding to see the students grow as individuals and come together as a team. Team Element which he and Sheila Bell of Swann Systems mentored, were well deserved winners of the Best Company Award at the Finals of the Rugby Branch of Young Enterprise (YE) on the evening of 6th April 2011 at Rugby High School. Team Element students also scooped four of the individual awards which was a huge achievement as they were one of the smallest teams, comprising only 8 students. They then went forward to represent the Rugby area in the YE Coventry & Warwickshire Finals at Coventry University on the 12th May. Unfortunately they were up against very strong competition; the eventual winners were a team from Stratford-upon-Avon with their Shakespeare themed cookbook ‘Much a do about cooking'. YE brings together business, educators and students into an environment where they can all learn from each others' experience. To spread the word about this volunteer work we submitted and had published an article in Coventry & Warwickshire Chamber May/June magazine.
