About

Welcome to First Will Write your first Will today and worry about your last Will later.

Using First Will you can write your Basic Legal Format Will using this easy to follow CD.
First Will uses a series of templates that have been prepared by a solicitor, so that you may write your own legally binding Will in the comfort of your own home. The legal profession acknowledge that a Will is better than no Will.

Why make a will and who should make one?

Why make a will?
It is accepted by the legal profession that a will is better than no will at all. So preparing and signing a Basic Legal Format Will is a positive step to protecting your family and your assets.
Making a will is the only way to ensure that your personal wishes are accurately dealt with after your death, thus providing you with complete peace of mind.
There are many reasons for making a will. The main reasons are:
It is a clear way by which you can control who gets your property after your death.
Your assets can be managed properly and put to their best use by the person (or people) you choose to administer your estate.
You can appoint a guardian for your children.
If you don't make a will:
Your estate will be distributed under fixed rules of law, it may not benefit the people you want it to.
Your children, if you have any, will become the responsibility of Social Services. If you do not want this to happen - make a will now.

Who can write a will?
Anyone over 18 may make a will. You can make a will provided you are over 18 years of age and have what is known as `testamentary capacity'. This means that:
You must know what you are doing and be aware of the implications
You must be aware of the extent of the property which you are disposing of and have regard for your legal and moral obligations to particular beneficiaries.
You must know and approve the contents of your will at the time you sign it, otherwise it may be contested after your death. If you later have cause to regret any particular provision, this will remains valid until you revoke it or amend it by a codicil or write a new will.
If you are a soldier on active service or a sailor on maritime service you can make a will even if you are under 18. In such circumstances you can also make a will orally without complying with the formalities for execution. You will also be able to revoke your will informally.
The text above is an example of one of the information files contained on the First Will personal CD
