Enforcement action can be taken by Trading Standards resulting in prosecution and a fine - currently set at a minimum of £500 and a maximum of £5,000. This is a repeated fine until a certificate is produced.When must I provide one?On a sale or letting of a property:At the earliest opportunity Before entering into a contract to sell or rent When providing written information to a prospective buyer or tenant Or when they first view the property The Energy Performance of Buildings Directive has introduced new certification requirements for all commercial buildings across Europe. Property owners and landlords will not be able to complete any property transactions without having an EPC. Implementation dates and the level of certificate needed are being phased in based on building size and complexity.When do you need a certificate by?The full timetable of the implementation is provided below: 6 April 2008 EPCs required on construction for all dwellingsEPCs required for the construction, sale or rent of buildings otherthan dwellings with a floor area over 10,000 m21 July 2008 EPCs required for the construction, sale or rent of buildings otherthan dwellings with a floor area over 2,500 m21 October 2008 EPCs required on the sale or rent of all remaining dwellingsEPCs required on the construction, sale or rent of all remainingbuildings other than dwellingsEPC's are required from 1st October 2008 for all "conditioned" commercial buildings over 50m sq when they are sold, let, modified or constructed. A "conditioned" building is one with a roof and walls which uses energy to condition the indoor climate i.e. some levels of heating, mechanical ventilation or cooling.What's involved?It is the responsibility of the property developer, owner, or landlord to obtain an EPC. They will need to find an accredited EPC assessor to survey their property portfolio and produce the certificate. This typically involves looking at full building plans, surveying the building, constructing a computer model, making recommendations and registering the certificate with the government's online database. What buildings will be exempt?The following places will not require an EPC :Places of worship Stand-alone building of less than 50 square meters (except for dwellings) Temporary buildings with a planned time of use of 2 years or less Particular building with a low energy demand (e.g. barns) In some circumstances buildings to be demolished are exempt.An EPC is not required for any (off-plan) sales or letting before the construction of the building has been completed. An EPC is valid for ten years, or until a newer EPC is prepared.The Regulations on EPCs were updated in September 2008, and came into force for October 2008 and stated: Any non-domestic building on the market before 1st October and remaining on the market will need an EPC by 4th January at the latest. If it is sold or rented out in the meantime, an EPC must be commissioned and then handed over as soon as is practicable.This measure is intended to make it easier for owners and landlords to comply with the legislation, avoid market fluctuations and is in response to expectations from the industry.At in-energy we provide Energy Performance Certificates for commercial and residential properties.
