Building Defects - SMC Chartered Surveyors provides a range of building surveying services, including: Diagnosis of specific defects; Expert advice on specific problems and their remedies, including disputes over workmanship; Project management of new build and refurbishment schemes for domestic and commercial properties; Building surveys prior to purchase; Schedules of condition, which are typically required before a tenant commits to signing a lease; Preparation of schedules of dilapidation and Scott Schedules in connection with dilapidations claims; Reinstatement cost assessments for insurance purposes; Expert testimony and reports in cases of dispute which may go to Court.

Residential Surveys - SMC Chartered Surveyors provides two different types of residential survey:
Homesurvey & Valuation (HSV).

This is the most popular type of report, and is designed to give factual information on significant aspects of the condition of the property to the prospective purchaser. The Homesurvey provides a market valuation and rebuilding valuation whilst identifying any defects considered urgent or of significant importance.

Building Survey - This is much more detailed than a Homesurvey and will usually give a valuation of the property. We will advise on the structural stability of the building, reference to visible defects, together with recommendations for remedial works. A photographic appendix is also attached.

Commercial Surveys - SMC Chartered Surveyors undertakes surveys of commercial buildings for a variety of purposes: Condition surveys - If you are purchasing a building and want to know if the property is in a good state of repair, or not, we can undertake a detailed inspection and report on the condition of the property. If you already own a property, we can also provide an opinion on the state of repair and make recommendations as to remedial work and preventative maintenance.
Schedules of condition

Tenants are often well-advised to have a schedule of condition prepared before the commencement of a lease. The schedule can then be appended to the lease and acts to protect the tenant from a full repairing liability. This is particularly important where older buildings are being leased or where the lease is relatively short. The last thing a tenant needs is a huge repair bill at the end of a lease and a schedule of condition helps to mitigate these costs.
Schedules of dilapidation - These are usually served on a tenant at the end of a lease (but sometimes during a lease) and record the breaches of the tenant's repairing and decorating covenants, with an estimate of the costs of remedying the breaches. We offer a full service, including negotiations with the tenant and supervision of works, S.18 valuations, expert witness reports and Court testimony.

In some instances, a tenant can serve a schedule of dilapidations on the landlord, if the landlord is responsible for certain repairs and has failed to repair common areas and services adequately, for example.

SMC Chartered Surveyors Offer Expert Advice To Ensure That Exposure To Business Rates Is Minimised Wherever Possible

Business rates are one of the largest overheads and business can face (after salaries and rent). It is important to ensure that exposure to rates is minimised wherever possible.

This can mean making appeals against the business rates assessment, whether against the original rating list assessment or against any subsequent alterations to the list made by the Valuation Officer.

It can also mean making applications for short term relief against rates, where temporary circumstances apply.

With most property owners having to pay full rates on empty properties, it is also important to understand the ways that a property owner can minimise their exposure to rates in these circumstances.

Also, with the complicated provisions associated with transitional adjustment, it is important that action is only taken where the effect of these calculations on rates payable are fully understood.

SMC Chartered Surveyors Offer Expert Advice To Landlords And Tenants In The Complicated Area Of Dilapidations

Dilapidations is a complicated area which requires expert advice, whether you are a landlord wanting to ensure a property is brought back into repair or a tenant trying to minimise exposure to a claim on exiting a lease.

Our building surveyor will prepare a schedule of dilapidations and cost up the schedule for service on the tenant, or alternatively will investigate a schedule prepared by a landlord to see if it is accurate and properly costed. The extent of the dilapidations claim will depend on the lease terms and the intentions of the landlord. We undertake negotiations on behalf of our clients with a view to agreeing the extent of the works.

At the termination of the lease, the landlord's claim is often limited to a financial settlement (‘damages') in lieu of works being undertaken. Damages cannot exceed the loss to the landlord in the value of its reversionary interest, which is where S.18 diminution in value calculations come in. We are experienced in providing such calculations.

In cases that cannot be agreed, we are experienced in providing expert witness reports and testimony in Court.

If, for any reason, a negotiated settlement cannot be reached, we have the skills and qualifications necessary to represent our clients professionally if referrals to independent third parties become necessary (arbitration or independent expert).
