"you acted in self-defence when NHS staff, assisted by police officers, forcible and without your consent, took an unnecessary blood test from you, Your actions were proportionate to the threat of assault and you were unable to escape the situation otherwise. This was your position during preparation for trial but the medical records, which you personally obtained some time later through a subject access request, were not obtained by your solicitor. The records support your defence. The commission considers the amounts to a claim of defective representation as it suggest your defence was not properly prepared and presented."
