23rd September 2013 To whom it may concern I am a barrister in private practice at Trinity Chambers, specialising in commercial/chancery litigation and employment law. I have been instructed on a number of cases by Quo Vadis Forensics Limited (QV) under the Bar’s public access scheme. I have worked closely with QV’s directors, Frank Nesbitt and Steve Mackle on several matters which have involved investigation into the financial affairs of companies and individuals. QV have provided in some of those cases a Personal Credit Data report (PCD), which I have found to be a useful tool, both in assessing the financial wherewithal of a potential defendant, and in tracing assets which may have been misappropriated. In two particular cases, the PCD has informed the litigation strategy to be adopted at an early stage, and in a way which has saved significant time and cost. I understand that QV obtain some of the content of the PCD from credit reference agencies by making requests, utilising the exemption provisions within ss.29 and 35 of the Data Protection Act 1998. I am not aware of any case in which QV’s methodology in obtaining this information has been challenged, and it would appear that the credit reference agencies are satisfied that they are not breaching their obligations under the relevant provisions of the DPA by acceding to these requests. I am more than happy to vouch for the integrity and professionalism of Mr Nesbitt and Mr Mackle. As former senior ranking police officers they are careful to ensure that their conduct is beyond reproach and I understand that they have adequate insurance in place should the need arise.
