At Yorkshire Riding Wills our Will Writer, Sara Esler, is a qualified associate of the Institute of Professional Will Writers. Sara attends a set number of hours continuing professional development training every year as required by the Institute of Professional Will Writers and has full professional indemnity insurance.

Wills & Estate Planning

70% of the UK population does not have a will. Many of us simply don't get round to it or mistakenly believe that our estate will go to the right people.
The laws of intestacy do not give you full control of where your estate will go when you die. For instance if you are not married and have no close relatives your Estate will automatically pass to the government.
By making a Will you can decide exactly who gets which assets and how much. This could be almost anything from personal belongings to pets or property. You will also help avoid unnecessary arguments amongst family members or relatives that could arise.
If you have children and you do not appoint guardians the Local Authority will be in loco parentis and will therefore decide where your children will live and with whom. By making a will you can be assured that you decide what is best for your children when you die.

Trusts

If you do not make financial provision for your children's future a statutory Children's Trust will be set up which puts huge restrictions on how money can be used for their benefit. By specifying clauses in a Children's Trust you can ensure that the money is used in the way that you would wish for the benefit of your children. You can also appoint Trustees who you know and trust to administer this in the best interests of your children.
In a trust you can also specify when you would like your children or grandchildren to inherit money. You may feel 18 is too young.
It is also important to set up a trust if you have children with disabilities so that they are looked after properly after you die.
Trusts are also an important estate planning tool which enable you to ensure that the maximum amount of your hard earned savings and assets go to those you want it too, rather than to central or local government.

Long-term care

Many of us fear having to sell our homes to pay for care home fees and having our spouse or partner left without a home. Unfortunately giving away our assets before this happens will not stop this taking place. Making a will can help ensure this doesn't transpire by setting up Protective Property Trust.

Inheritance Tax

Inheritance Tax is paid on estate valued at over £325000, at a rate of 40%. With the average house price in April 2014 at £260000 nationally this means that more and more people can find their estate would fall above this and this would mean that when they die their beneficiaries would be liable to pay large amounts of tax to HMRC.
There may be certain things you can do to mitigate this within your lifetime as well as in your will. You can discuss this with our will writer.

Secure Storage of Wills

Of the wills that are written, an astonishing 40% are missing when the person dies. This then means the rules of intestacy come into play. In order to avoid this we advise you to store your will safely and securely with APS Legal & Associates Ltd.
